Cumberland County, through the Community Development Department, has prepared a Substantial Amendment to its Program Year (PY) 2021 Annual Action Plan. This notice provides information regarding the public review period required under Federal Regulations at 24 CFR 91.105.

As required by HUD, Cumberland County is required to prepare a one-year action plan which describes the proposed projects that will be funded during the Program Year / Fiscal Year. The Action Plan is also part of the 2020-2024 Consolidated Plan (5-Year Strategic Plan) which includes the priority needs and the goals and objectives Cumberland County plans to accomplish to meet the needs of the community during the five-year period. The Program Year 2021 Annual Action Plan will be the second year of achieving the goals outlined in the Consolidated Plan.

For the Program Year (PY) 2021, Cumberland County was originally allocated $890,600 in Community Development Block Grant (CDBG) funds and $396,328 in Home Investment Partnership Program (HOME) funds. These funds are used for programs and projects that benefit primarily low- and moderate-income residents for a given year.  The Substantial Amendment to the Annual Action Plan will increase the CDBG program funding to $903,724 and Cumberland County will receive additional HOME funding from the American Rescue Plan Act in the amount of $1,435,021. The additional HOME funds are to be prioritized for housing and shelter options for specific populations. A Substantial Amendment to the PY 2021 Annual Action Plan usually allows for a thirty (30) day public comment period. However, HUD has waived this requirement provided that no less than three (3) days are provided for public comments on each substantial amendment.

PUBLIC COMMENT

The draft amendment will be available for public comment and review from June 16, 2021 through June 22, 2021. Review of the documents will be available at the following locations: Cumberland County Community Development, 707 Executive Place, Fayetteville, NC (by appointment only).

In addition to the location listed, the documents will also be available on the Cumberland County’s website at www.co.cumberland.nc.us (through the Community Development Department). The public is invited to submit written comments on the proposed Amendment. All questions and comments relative to the document must be received by 5:00 p.m., June 22, 2021 at the Cumberland County Community Development office.  Written comments can be submitted by mail to Cumberland County Community Development, 707 Executive Place, Fayetteville, NC 28305 or by email to cccdinfo@co.cumberland.nc.us.

It has been determined that such request for release of funds will not constitute an action significantly effecting the quality of the human environment and, accordingly, the above-named County has decided not to prepare an Environmental Impact Statement under the National Environmental Policy Act of 1969.

An Environmental Review Record pertaining to this project has been made by the above-named County which documents the environmental review of the project and more fully sets forth the reasons why such statement is not required.  This Environmental Review Record is on file at the above address and is available for public examination and copying, upon request, at Cumberland County Community Development, 707 Executive Place, Fayetteville, North Carolina between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday.

No further environmental review of such project is proposed to be conducted, prior to the request for release of funds.

PUBLIC COMMENTS ON FONSI

All interested agencies, groups, and persons disagreeing with this FONSI decision are invited to submit written comments for consideration by Cumberland County to the office of Community Development Department, 707 Executive Place, P.O.  Drawer 1829, Fayetteville, NC 28302, on or before (October 19, 2020) at 5:00 p.m.  All such written comments so received will be considered and Cumberland County will not request the release of Federal Funds or take any administrative action on the proposed project prior to the date specified in the preceding sentence.

NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

At least one day after the termination of the public comment period for the FONSI but not before comments on the FONSI have been considered and resolved, Cumberland County will submit a Request for Release of Funds (RROF) and Certification to HUD.  Cumberland County is certifying to HUD that the County and the chief executive officer or other officer of the County approved by HUD, in his/her official capacity as County Manager, consent to accept the jurisdiction of the Federal courts if an action is brought to enforce responsibilities in relation to environmental review, decision making, and action; and that these responsibilities have been satisfied.  The legal effect of the certification is that upon its approval, the Certifying Officer, County Manager, Amy Cannon, may use the CDBG funds and HUD will have satisfied its responsibilities under the National Environmental Policy Act of 1969 and related laws and authorities.  

OBJECTIONS TO RELEASE OF FUNDS

PUBLIC REVIEW AND COMMENT PERIOD

 

In continuing our efforts to enhance citizen participation among County residents, Cumberland County Community Development (CCCD) has made available for your review and comment a draft of the Program Year (PY) 2019 Consolidated Annual Performance and Evaluation Report (CAPER). 

The CAPER provides information on Cumberland County’s use of the Community Development Block Grant and HOME Investment Partnership Act grant funds during PY2019 (July 1, 2019 - June 30, 2020).  This allows the County an opportunity to evaluate its overall progress in carrying out the priorities and specific objectives identified in its 2019 Annual Action Plan.  All citizens are encouraged to review the document and offer comments.

The CAPER will be available for public comment and review from September 7, 2020 through September 21, 2020. Due to temporary closures of certain facilities and to help protect the community and staff from the spread of novel coronavirus (COVID-19), the Cumberland County Community Development Department will limit distribution of the CAPER to the following locations:

The public review and comment period will begin June 5, 2020 and runs through June 15, 2020.

 

BACKGROUND

On March 27, 2020, the Coronavirus Aid, Relief, and Economic Security Act (CARES Act), Public Law 116-136, was signed, providing $5 billion for Community Development Block Grant (CDBG) to rapidly respond to the coronavirus disease 2019 (COVID-19) and the economic and housing impacts caused by this unprecedented crisis.

Cumberland County has been awarded $509,194 in CDBG CARES Act funding (CDBG-CV). A Substantial Amendment to the PY 2019 Annual Action Plan will be required, and usually a thirty (30) day public comment period is required. However, HUD has waived this requirement provided that no less than five (5) days are provided for public comments on each substantial amendment.

The Substantial Amendment to the Annual Action Plan will allocate CDBG-CV program funding for specific programs and projects. These programs and projects are required to primarily benefit low- and moderate-income residents for a given year. The County’s Citizen Participation Plan has also been amended to reflect the changes in response to Presidentially declared emergencies.

Cumberland County Community Development (CCCD) invites you to attend a community meeting to provide your input for the preparation of a proposed Neighborhood Revitalization Strategy Area (NRSA) plan for the Shaw Heights neighborhood.  The NRSA will be an area designated by Cumberland County, as the grantee of the Community Development Block Grant (CDBG) program, to allow flexibility in undertaking certain types of projects and activities with the CDBG funds.  The NRSA plan will be submitted to the U.S. Department of Housing and Urban Development (HUD) for review and approval.  

 

In an effort to better understand the needs of the Shaw Heights neighborhood, the following meetings will be conducted to give residents the opportunity to offer input regarding future projects and activities for the neighborhood:

Residents are encouraged to attend and provide input and comments.  CCCD staff will be on hand to answer any questions you may have about the programs.  Please note that income restrictions may apply for participation in certain programs.
